These Terms & Conditions apply to purchases made from Balloon D’Or through our website and, where applicable, to orders placed directly with us. Please read them carefully before placing an order.
Nothing in these Terms affects your statutory rights as a consumer.

Throughout these Terms, references to “Balloon D’Or”, “we”, “us” or “our” mean Elegant Occasions Limited trading as Balloon D’Or.
2. Orders and Personalisation
When placing an order, customers are responsible for checking that the information they provide is correct, including names and personalised messages, ages and numbers, balloon colours and designs, collection or delivery date, and any other personalised requirements.
Balloon D’Or will produce personalised items using the information supplied by the customer.
Customers should therefore check spelling, numbers, dates, colours and all other personalised details carefully before confirming their order.
If Balloon D’Or makes an error in producing an order, we will put it right in accordance with the customer’s statutory rights.
If the customer supplied incorrect information and Balloon D’Or has already produced or personalised the product correctly according to those instructions, we may need to charge for the product to be remade.
3. Product Images, Colours and Availability
Balloon D’Or takes reasonable care to ensure that product photographs and descriptions accurately represent our products.
Colours and finishes may appear slightly different on different screens or under different lighting conditions. Minor variations may also occur between manufacturing batches.
Where a particular balloon, colour or accessory becomes unavailable after an order has been placed, Balloon D’Or will contact the customer where the change would materially affect the agreed design.
We will not make a significant substitution without the customer’s agreement.
Small decorative elements may occasionally vary where necessary, provided this does not materially change the overall design, quality or value of the arrangement.
4. Prices and Payment
All prices displayed on the Balloon D’Or website are shown in pounds sterling (£) and include VAT where applicable.
All online orders must be paid for in full at the time the order is placed. Balloon D’Or does not operate a deposit or balance-on-collection system for website orders.
Payment must be made using one of the payment methods offered at checkout.
An order is confirmed once payment has been successfully received and the customer has received their order confirmation.
In the event of an obvious pricing, product-information or technical error, Balloon D’Or may contact the customer to correct the issue or cancel the affected order. Where an order is cancelled by Balloon D’Or after payment has been taken, the customer will receive a full refund for the affected order.
5. Changes and Cancellations
If a customer wishes to change or cancel an order, they should contact Balloon D’Or as soon as possible.
Where an order has not yet been prepared, personalised or otherwise committed to production, Balloon D’Or will consider requested changes and cancellations where reasonably possible.
Many Balloon D’Or products are made, personalised or prepared specifically to the customer’s requirements. Where applicable, personalised or bespoke goods may not carry the normal right to cancel simply because the customer has changed their mind.
Once Balloon D’Or has begun personalising or preparing a bespoke order, we may be unable to accept a cancellation or make changes to that order.
If a requested change can still be made but results in additional products, materials or work being required, the customer will be advised of any additional charge before the change is made.
Cancellation restrictions do not affect a customer’s statutory rights where goods are faulty, not as described or otherwise do not conform to the contract.
If Balloon D’Or has to cancel an order for reasons within our control and cannot offer an acceptable alternative, any amount paid for the affected order will be refunded.
6. Collection of Orders
Customers must collect their order from Balloon D’Or on the date and at the collection time agreed when the order was placed.
Balloon arrangements are prepared with the agreed collection time in mind. If a customer expects to be late, they should contact Balloon D’Or as soon as possible.
If an order is collected substantially later than the agreed time, Balloon D’Or cannot guarantee the same remaining float or display life that would have been expected had the order been collected on time.
Customers should check their order at collection wherever reasonably possible and raise any apparent problem with a member of staff before leaving.
Customers are responsible for ensuring they have a vehicle with sufficient suitable space to transport their order safely.
Balloon D’Or cannot accept responsibility for damage caused by an unsuitable vehicle or by the customer’s transportation or handling after collection, except where the goods were already faulty or otherwise did not conform to the contract when supplied.
Uncollected Orders
Because many Balloon D’Or products are inflated, personalised or prepared for a particular date, they may have little or no value after that date.
If an order is not collected on the agreed date, customers should contact Balloon D’Or as soon as possible.
We will deal with the circumstances reasonably but cannot guarantee that inflated or prepared products will remain suitable for collection at a later date.
Where an order has been made or personalised specifically for the customer, a refund will not normally be available simply because the customer failed to collect it, subject always to the customer’s statutory rights.
7. Delivery of Orders
Where delivery is available, customers are responsible for providing a complete and accurate delivery address, contact telephone number and any relevant access information when placing their order.
Balloon D’Or will make reasonable efforts to deliver on the agreed date and within any agreed delivery window. Any delivery time given is an estimate unless Balloon D’Or has expressly agreed otherwise.
Customers must ensure that somebody is available to receive the order at the delivery address at the agreed time.
If delivery cannot be completed because nobody is available, the address or access information supplied is incorrect or incomplete, or access to the property is not reasonably possible, Balloon D’Or will attempt to contact the customer.
Where a further delivery attempt is required because of circumstances within the customer’s control, an additional reasonable delivery charge may apply.
Balloon arrangements will not normally be left unattended unless this has been expressly agreed with the customer and it is reasonably safe to do so.
Where a customer specifically asks Balloon D’Or to leave an order in an agreed safe place or with another person, Balloon D’Or will follow those instructions where reasonably possible. Once the order has been left in accordance with those instructions, Balloon D’Or cannot be responsible for subsequent loss or damage caused by circumstances outside our control.
If Balloon D’Or is unable to fulfil a delivery because of circumstances within our control, we will contact the customer and provide an appropriate solution, which may include rearranging delivery or providing a refund where appropriate.
Nothing in this section affects the customer’s statutory rights.
8. Balloon Care and Customer Responsibility
Balloons are delicate and temporary products and should be handled with care.
Once balloons have been collected from Balloon D’Or, customers are responsible for transporting, handling and storing them appropriately.
- Keep balloons away from sharp objects, rough surfaces, naked flames and sources of heat.
- Avoid exposing balloons to extreme heat or cold.
- Do not leave balloons inside a parked vehicle, particularly during hot or cold weather.
- Ensure sufficient space is available in the vehicle when collecting larger balloon arrangements.
- Do not place balloons against ceilings, walls or surfaces that may be hot, rough or sharp.
- Children should be appropriately supervised around balloons.
Balloon Float and Display Life
Balloon float and display times vary depending upon the type and size of balloon, environmental conditions, temperature and handling.
Balloon D’Or therefore cannot guarantee that every balloon will remain inflated or maintain its original appearance for a specific period unless a specific guarantee has expressly been provided for that product.
Outdoor Use
Balloons and balloon decorations used outdoors are particularly affected by weather conditions including heat, cold, wind, rain and direct sunlight.
Balloon D’Or cannot guarantee the performance or longevity of balloons used outdoors where deterioration or damage results from environmental conditions outside our control.
These provisions do not affect a customer’s statutory rights where a product was faulty, damaged or otherwise did not conform to the contract when supplied.
9. Helium and Balloon Safety
Balloon D’Or takes balloon and helium safety seriously. Customers must follow any safety information supplied with their order.
Helium
Helium must never be inhaled.
Although helium is non-toxic and non-flammable, inhaling helium can displace oxygen from the lungs and may cause dizziness, unconsciousness, serious injury or death.
Children must be appropriately supervised around balloons.
Babies and young children should never be allowed to play unsupervised with balloons, balloon fragments, ribbons or other small balloon accessories.
Uninflated balloons and pieces of burst balloons can present a choking or suffocation hazard and should be kept away from young children and disposed of safely.
Balloons should never be placed over a person’s head or face.
Balloon ribbons and strings should also be used responsibly and kept away from babies and young children where they could present an entanglement risk.
Where Balloon D’Or supplies additional safety instructions with an order, customers should read and follow those instructions.
Balloon Releases
Balloon D’Or recommends that balloons are not intentionally released outdoors.
Foil/Mylar balloons must never be deliberately released. They can become caught in trees, overhead cables and other structures and may present risks to wildlife, the environment and infrastructure.
Although natural latex balloons may be marketed as biodegradable, they should still be disposed of responsibly rather than deliberately released into the environment.
Customers should always comply with any applicable local restrictions concerning balloon releases and dispose of balloons, ribbons, weights and other accessories responsibly.
10. Faulty, Damaged or Incorrect Products
Balloon D’Or takes reasonable care to ensure that all balloon arrangements are prepared correctly and are in good condition when supplied to the customer.
Customers should check their order at the time of collection wherever reasonably possible and tell us immediately if anything appears incorrect or damaged.
If an item supplied by Balloon D’Or is faulty, damaged when supplied, incorrectly personalised due to an error by Balloon D’Or, or otherwise does not conform to the customer’s order, please contact us as soon as reasonably possible.
We will assess the problem and, where appropriate, offer a replacement, repair or refund in accordance with the customer’s statutory rights.
Once an order has been collected, customers are responsible for taking reasonable care when transporting, handling and storing their balloons.
Balloon D’Or cannot accept responsibility for damage occurring after collection as a result of circumstances outside our control, including punctures, contact with sharp or rough surfaces, excessive heat or cold, unsuitable transportation, incorrect storage, deliberate or accidental damage, or balloons being left in a vehicle.
Because balloons are temporary products, their appearance and float life will naturally change over time. Float life can also be affected by temperature, environment, handling and the type and size of balloon.
Nothing in these Terms affects the customer’s statutory rights in relation to goods that are faulty, not as described or otherwise do not conform to the contract.
11. Refunds
Balloon D’Or wants customers to be satisfied with their order. If there is a problem, customers should contact us as soon as reasonably possible so that we can investigate and resolve the matter.
Where goods are faulty, damaged when supplied, incorrectly produced by Balloon D’Or, not as described or otherwise do not conform to the contract, customers will be entitled to the remedies available under UK consumer law.
Depending upon the circumstances, this may include a replacement, repair, price reduction or refund.
Refunds will normally be made using the same payment method originally used to purchase the order, unless otherwise agreed.
A refund will not normally be provided simply because a customer changes their mind about a personalised or bespoke product where the applicable cancellation rights do not apply.
Similarly, Balloon D’Or will not normally provide a refund where a product has been correctly produced according to information supplied by the customer but the customer supplied incorrect personalisation, numbers, dates, colours or other instructions.
Nothing in this policy limits or excludes the customer’s statutory rights.
12. Events Outside Our Control
Balloon D’Or will make every reasonable effort to fulfil orders as agreed. However, we will not be responsible for delays or failure to perform our obligations where this results from circumstances genuinely outside our reasonable control.
Such circumstances may include severe weather, flooding, fire, major transport disruption, power or utility failures, government restrictions or significant disruption to essential suppliers.
If such an event affects an order, Balloon D’Or will contact the customer as soon as reasonably possible and take reasonable steps to minimise the effect of the disruption.
Where the disruption means Balloon D’Or cannot reasonably fulfil the order, we will discuss the available options with the customer, which may include rearranging the order, agreeing a suitable alternative or providing an appropriate refund.
Nothing in this section affects the customer’s statutory rights.
13. Liability
Balloon D’Or is responsible for losses suffered by a customer that are a foreseeable result of Balloon D’Or breaching these Terms or failing to use reasonable care and skill.
Balloon D’Or will not be responsible for losses that could not reasonably have been foreseen when the contract was entered into or for losses resulting from circumstances outside our reasonable control.
Balloon D’Or will not be responsible for damage to balloons or arrangements caused after collection or delivery by improper handling, unsuitable transportation or storage, extreme temperatures, sharp objects, environmental conditions or failure to follow safety or care instructions supplied with the product.
Products supplied through the Balloon D’Or consumer website are intended for personal and domestic use unless otherwise agreed. We are not responsible for business losses such as loss of profits, revenue or business opportunity arising from a consumer purchase.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any rights that cannot legally be excluded under consumer law.
14. Privacy and Personal Information
Balloon D’Or collects and uses customers’ personal information in order to process and fulfil orders, communicate with customers and operate our services.
Personal information will be handled in accordance with applicable UK data-protection law and our Privacy Policy, which explains what information we collect, how it is used, how long it may be retained and the rights available to customers.
Where customers choose to receive marketing communications from Balloon D’Or, they may withdraw their consent or unsubscribe from those communications at any time using the methods provided.
Information required to process or fulfil an order may still be used for that purpose even where a customer has chosen not to receive marketing communications.
15. Website Information and Errors
Balloon D’Or takes reasonable care to ensure that information, descriptions, photographs and prices displayed on our website are accurate.
Occasionally, errors or omissions may occur.
If we discover an obvious error affecting a product, price or order after an order has been placed, we will contact the customer as soon as reasonably possible.
Where an error means that we cannot reasonably fulfil the order as originally agreed, we will give the customer the opportunity, where appropriate, to proceed on corrected terms or to cancel the affected order and receive a full refund of any amount paid for it.
Product availability may change, particularly during busy or seasonal periods. Where an ordered item becomes unavailable, we will follow the substitution and availability provisions contained in these Terms.
Nothing in this section affects the customer’s statutory rights.
16. Governing Law and General Terms
These Terms and any contract between the customer and Balloon D’Or are governed by the laws of England and Wales.
Customers living in Scotland or Northern Ireland will also retain any mandatory consumer rights available to them under the laws applicable where they live.
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
If Balloon D’Or does not immediately enforce any right under these Terms, this does not mean that we have waived that right.
Balloon D’Or may update these Terms from time to time. The Terms applying to an order will normally be those in force when that order was placed.
These Terms do not affect any statutory rights that customers are entitled to under applicable consumer law.
